Is Weave AI HIPAA compliant?
Weave Communications signs a Business Associate Agreement with its customers, which HIPAA requires before a vendor handles patient data for you. Once it's signed, you can use Weave AI with patient data within the BAA's scope; whether your use is compliant still depends on your setup and your own policies. Weave Communications doesn't say whether the BAA covers its AI features.
Does Weave AI sign a BAA?
Yes, it signs a BAA
Weave publishes a Business Associate Addendum that its Terms of Service incorporate, so subscribers get a BAA as part of the standard agreement. The BAA expressly allows PHI to be used in AI systems as HIPAA permits, but the separate AI Receptionist Terms don't mention the BAA and put data security, including PHI, on the subscriber.
Not confirmed for the AI features: Weave Communications doesn’t say whether its BAA covers Weave AI Receptionist (calls and texts). Get that in writing before using it with patient data.

By plan
| Plan | BAA | How to get it | Conditions |
|---|---|---|---|
| Weave subscription (all plans) | Signs a BAA | Included in the termsRequest page | The Terms of Service list the Business Associate Agreement among the documents they incorporate, and the BAA takes effect when the underlying agreement is executed. Neither document ties the BAA to a plan or tier. The BAA lets Weave terminate if HIPAA changes or a client agrees to restrictions that would cause Weave unexpected compliance costs.[1],[2] |
Are the AI features covered?
Vendors often sign a BAA for the core product but leave some AI features out. Here is what Weave Communications says about each one.
| AI feature | Under the BAA | Details |
|---|---|---|
| Weave AI Receptionist (calls and texts) | Not stated | The BAA (section 3.3) allows Weave to use PHI in internal and external AI systems as HIPAA permits, and the Terms list AI Receptionist as a Weave feature. However, the AI Receptionist Terms don't mention the BAA or HIPAA, make the subscriber solely responsible for data security including PHI, and record all calls by default for quality, training and service improvement. Weave doesn't say explicitly whether the BAA covers this feature. Separately, the Terms (section 6.3) let Weave use subscriber data to develop AI tools consistent with its BAA, DPA and privacy policy.[1],[2],[3] |

A signed BAA is necessary but not sufficient for HIPAA compliance, which also depends on configuration, access controls, and your own policies. Verdicts summarize the vendor's own published terms as of the date checked; confirm with the vendor and your counsel before sending protected health information. Not legal advice.
