Signs a BAA
By plan
| Plan | BAA | How to get it | Conditions |
|---|---|---|---|
| All TherapyNotes subscriptions (covered entities), incl. TherapyFuel add-on | Signs a BAA | Included in the terms | Since April 23, 2026 the BAA applies through acceptance of the Terms of Service, with nothing to sign or upload, and existing customers need to do nothing. An older help article describes the previous process of downloading, signing and uploading the BAA in Settings. TherapyFuel is free under a promotion for now and will then cost $40/month per enabled user.[1],[2],[3] |
Are the AI features covered?
Vendors often sign a BAA for the core product but leave some AI features out. Here is what TherapyNotes, LLC says about each one.
| AI feature | Under the BAA | Details |
|---|---|---|
| TherapyFuel (AI scribe, progress-note and treatment-plan drafting) | Covered | The FAQ says TherapyFuel is covered under the BAA with the practice, and that any vendor involved must also sign a BAA with TherapyNotes that forbids training on the data. Audio is deleted after transcription, and transcripts are kept until the note is signed or for 30 days. A stock vendor model is used that does not learn from use. Only Therapy Progress Notes and Treatment Plans are supported for now.[2] |

A signed BAA is necessary but not sufficient for HIPAA compliance, which also depends on configuration, access controls, and your own policies. Verdicts summarize the vendor's own published terms as of the date checked; confirm with the vendor and your counsel before sending protected health information. Not legal advice.
