Is OCI Generative AI HIPAA compliant?

Oracle signs a Business Associate Agreement with its customers, which HIPAA requires before a vendor handles patient data for you. Once it's signed, you can use OCI Generative AI with patient data within the BAA's scope; whether your use is compliant still depends on your setup and your own policies. Oracle doesn't say whether the BAA covers all of its AI features.

Does OCI Generative AI sign a BAA?

Yes, it signs a BAA

Oracle enters into BAAs with OCI customers, and 'Generative AI' is on its list of HIPAA-assessed OCI services. The BAA is negotiated with Oracle rather than included in a subscription, and Oracle says agent features and partner-hosted models (Gemini, Grok) should be confirmed before sending PHI.

Based on 3 sources, all from Oracle unless marked.

Not confirmed for the AI features: Oracle doesn’t say whether its BAA covers Google Gemini and xAI Grok models on OCI Generative AI; OCI Generative AI Agents. Get that in writing before using them with patient data.

OCI customers with an executed Oracle BAASigns a BAAThrough salesOracle says OCI supports HIPAA customers by entering into a BAA, and an Oracle architect's 2026 post says the BAA must cover the services in use and is not implied by a subscription. No self-serve signing process is published, so the route is presumed to be through Oracle sales. Use a HIPAA-assessed region (Oracle lists US East, US West, US Midwest and many others).[1],[2],[3]

Are the AI features covered?

Vendors often sign a BAA for the core product but leave some AI features out. Here is what Oracle says about each one.

A signed BAA is necessary but not sufficient for HIPAA compliance, which also depends on configuration, access controls, and your own policies. Verdicts summarize the vendor's own published terms as of the date checked; confirm with the vendor and your counsel before sending protected health information. Not legal advice.
